New York Driver Responsibility Program

The State of New York has implemented a program to hold motorists accountable when they refuse to obey specific rules of the road.  The New York Driver Responsibility Program requires motorists to pay an assessment to the New York Department of Motor Vehicles for specific traffic violations.  The program aims to improve overall traffic safety and deter the repeat offenses from problem drivers.

 According to the website for the New York DMV, The Driver Responsibility Program, “Applies to all drivers who operate, or operated, a motor vehicle in the State of New York, regardless of the state the motorist is licensed in.” The assessment is a fee paid directly to the New York Department of Motor Vehicles in addition to any and all fees, fines, penalties, etc. associated with the original traffic violation. The fee is paid annually for three years (the fee can also be paid in full the first year, or the final two years paid the second year).

Any traffic violations in the following categories occurring on or after November 18, 2004 are subject to the assessments required by the New York Driver Responsibility Program:

  • Conviction of an alcohol-related traffic violation in New York State (including boats and snow-mobiles).
  • Conviction of a drug-related traffic violation in New York State (including boats and snow-mobiles).
  • DMV hearing determines the failure to submit to a chemical test in New York State.
  • Six or more points are received on a New York State driving record within 18 months. (Note: violations occurring in other states will not affect your driving record in New York with the exception of Quebec and Ontario, Canada. Any traffic violations that occur in Quebec, Ontario and New York State accumulating to six points or more in 18 months will result in having to the pay the assessment.)

The fees for the assessments are broken down as follows:

  • Conviction of an alcohol or drug-related violation results in a $250 annual fee. The fee is paid for three years and the total fee is $750.
  • The same fees apply for refusing to take a chemical test.
  • Six points on a New York State driving record requires a $100 annual payment for three years. However, if additional points are received the offender must pay an additional $25 per point per year beyond the original six points. (Example: 9 points would cost $175 annually).

The New York State Department of Motor Vehicles contacts drivers who are required to pay the assessment. Failure to pay the assessment either results in suspension of a New York State Drivers License or suspension of driving privileges in New York Sate.
